International IP Forum 2024


Oleksandr Mamunya interviewed Olena Orliuk, the Head of the Ukrainian PTO (National Office for Intellectual Property and Innovations), on strategic directions for the development of the IP sector in Ukraine during the International IP Forum 2024 held last week in Kyiv.

The discussion focused on a number of issues, including the following:

  • draft Strategy for IP Sphere;

  • perspectives of implementing the Bolar provision in Ukraine;

  • perspectives of full cancellation of the Law of Ukraine "On the Protection of Interests in the Field of Intellectual Property during Martial Law Introduced Due to the Armed Aggression of the Russian Federation Against Ukraine";  

  • launch of the new Chamber of Appeals of the PTO;

  • brand new platform of the PTO – Intellectual Property Rights Infringement Monitoring Center;

  • development of professional IP education and forming the respective educational environment to engage more students to IP profession.

Everyone wants to solve the problem, but it must be done in such a way that does not justify the improper application in the past.

"It is evident that the issue of improper application of the Law of Ukraine "On the Protection of Interests in the Field of Intellectual Property during Martial Law Introduced Due to the Armed Aggression of the Russian Federation Against Ukraine" in the part of term of validity of patents that have finally expired should be fixed. Everyone wants to solve the problem, but it must be done in such a way that does not justify the improper application in the past. There is also a need to address the question of the suspended prosecution terms," emphasized Oleksandr Mamunya.

should be abolished in full.

"In the consultations held with the Parliament, we clearly demonstrated our position: the PTO believes that such a law [the Law of Ukraine "On the Protection of Interests in the Field of Intellectual Property during Martial Law Introduced Due to the Armed Aggression of the Russian Federation Against Ukraine"] should be abolished in full," Olena Orliuk stated.
